1. Acceptance of Terms
By accessing or using Africa SPA System ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Platform.
These terms apply to all users of the Platform, including salon owners, staff members, administrators, and any other parties accessing the Platform.
2. Description of Service
Africa SPA System is a multi-tenant SaaS platform designed for salon and beauty business management across Africa. The Platform provides tools including but not limited to:
- Appointment scheduling and management
- Inventory and product management
- Staff management and payroll tracking
- Financial reporting and analytics
- Client relationship management (CRM)
- Multi-currency and multi-branch support
- Social media integration and marketing tools
3. User Accounts and Registration
To access certain features of the Platform, you must register for an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain and update your account information promptly
- Keep your login credentials confidential and secure
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities that occur under your account
We reserve the right to suspend or terminate accounts that provide false information or violate these terms.
4. Subscription and Billing
Certain features of the Platform require a paid subscription. The following terms apply:
- Subscription fees are billed in advance on a monthly or annual basis, as selected during registration
- Payment is processed securely through our integrated payment partners
- Fees are non-refundable except as explicitly stated in our refund policy
- We reserve the right to change pricing with 30 days' notice
- Non-payment may result in suspension or termination of access
5. Multi-Currency and Regional Compliance
Africa SPA System operates across 54 African countries and supports multiple currencies including but not limited to KES, NGN, ZAR, GHS, TZS, UGX, and XOF. By using the Platform:
- You acknowledge that currency conversion rates may apply
- You are responsible for compliance with local tax laws and regulations
- The Platform will attempt to apply appropriate regional settings based on your location
- We are not liable for any discrepancies in currency conversion or regional tax calculations
6. Data Privacy and Security
We take data privacy seriously. Our data handling practices are governed by our Privacy Policy. Key commitments include:
- All data is encrypted in transit and at rest
- We employ multi-tenant isolation to separate client data
- We adhere to applicable data protection regulations across African jurisdictions
- We do not sell your personal data to third parties
7. Acceptable Use
You agree not to use the Platform for any unlawful purpose or in violation of these terms. Prohibited activities include:
- Attempting to breach or circumvent security measures
- Accessing data not intended for your account
- Using the Platform to send unsolicited communications (spam)
- Uploading malicious code or content
- Engaging in any activity that could harm the Platform or its users
- Reverse engineering, decompiling, or disassembling the Platform
8. Intellectual Property
All content, features, and functionality of the Platform, including but not limited to software, design, text, graphics, logos, and trademarks, are owned by Africa SPA System or its licensors and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Platform for your business purposes. This license does not include the right to:
- Copy, modify, or create derivative works of the Platform
- Distribute, transfer, or sublicense access to the Platform
- Use the Platform for competitive analysis or benchmarking
9. Limitation of Liability
To the maximum extent permitted by applicable law, Africa SPA System and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.
Our total liability for any claims arising under these terms shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
10. Service Level and Availability
We strive to maintain Platform availability of 99.9% uptime, excluding scheduled maintenance. However:
- We do not guarantee uninterrupted or error-free service
- Scheduled maintenance will be communicated in advance when possible
- We are not liable for outages caused by third-party services or force majeure events
- Emergency maintenance may occur without notice to address security or critical issues
11. Termination
Either party may terminate this agreement as follows:
- You may cancel your account at any time through your account settings
- We may suspend or terminate access for violation of these terms
- Upon termination, your data will be available for export for 30 days
- After 30 days, your data will be permanently deleted from our systems
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
For users in other African countries, local consumer protection laws may provide additional rights that are not overridden by this agreement.
13. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective upon posting to the Platform. We will notify users of material changes via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the modified terms.
